The U.S. FDA Agent’s Actual Role for Foreign Device Establishments

Vinay ChandraBy Vinay ChandraNovember 3, 2026No Comments10 Mins Read

    Key Takeaways

Foreign establishments involved in manufacturing or processing medical devices imported into the United States generally must designate a U.S. agent.

The U.S. agent serves as a communications link between the FDA and the foreign establishment.

Each foreign establishment may designate only one U.S. agent, although the same agent may represent multiple establishments.

A U.S. agent must reside in the United States or maintain a physical place of business there.

The agent assists the FDA with questions about imported devices and with scheduling inspections of the foreign establishment.

The legally defined U.S. agent role does not include responsibility for submitting 510(k) notifications or filing Medical Device Reports.

Designating an agent does not transfer the manufacturer’s regulatory responsibilities or guarantee FDA authorization, import acceptance, or a particular review timeline.

Understanding the U.S. FDA Agent Requirement

Which Foreign Establishments Need an Agent?

A foreign establishment engaged in manufacturing, preparing, propagating, compounding, or processing a medical device imported or offered for import into the United States generally must designate a U.S. agent.

The requirement applies at the establishment level. If a company operates multiple foreign establishments that require FDA registration, each establishment must provide its own U.S. agent information. The establishments may appoint the same agent, but each appointment must be recorded through the applicable registration process.

The designation is submitted electronically as part of establishment registration through the FDA Unified Registration and Listing System. The foreign establishment provides the agent’s name, physical address, telephone number, and email address.

The designated agent receives an automated verification request from the FDA. The agent must confirm that it has agreed to serve in the role. If it denies the appointment or does not respond within 10 business days, the foreign establishment must designate another agent.

Establishment registration and device listing are separate from premarket review. Completing registration does not mean that the FDA has approved, cleared, or authorized the listed devices.

    Location and Availability Requirements

A U.S. agent must reside in the United States or maintain a place of business there. A post office box, mail drop, or answering service alone does not satisfy the FDA’s requirement.

The agent must be reachable during normal business hours. It may answer calls directly or have an employee available to respond.

The FDA may also need a physical address where agency staff can contact or visit the agent. Foreign establishments should verify that the address submitted during registration remains current.

Changes to the agent’s contact information should be updated through the appropriate FDA system. Outdated information can interrupt communications and create problems when the agency needs to reach the foreign establishment.

    Defining What the Agent Does

Serving as the FDA’s Domestic Contact

The FDA describes the U.S. agent’s responsibilities narrowly:

“The responsibilities of the U.S. agent are limited.”

Within that defined role, the agent assists the FDA in communicating with the foreign establishment. The agent may respond to agency questions concerning devices imported or offered for import into the United States.

The agent also helps the FDA schedule inspections of the foreign establishment. This can involve transmitting proposed inspection dates and supporting communication between the agency and the manufacturer.

If the FDA cannot contact the foreign establishment directly or promptly, it may send information or documents to the U.S. agent. Providing those materials to the agent is considered equivalent to providing them to the foreign establishment.

For this reason, the manufacturer should have an internal procedure for receiving and escalating FDA communications from its agent. Delays in forwarding an agency message could affect the manufacturer’s ability to respond within the requested period.

Recognizing the Limits of the Appointment

A U.S. agent is not automatically responsible for all regulatory activities associated with a medical device.

The FDA specifically states that the agent has no responsibility for:

    • Medical Device Reporting under 21 CFR Part 803
    • Submitting 510(k) premarket notifications
    • Operating the manufacturer’s quality management system
    • Making regulatory decisions for the FDA
    • Guaranteeing entry of shipments into the United States

A service provider may separately offer regulatory consulting, submission support, or registration assistance. Those services go beyond the minimum U.S. agent duties and should be described in a separate agreement.

Manufacturers should confirm which services are included before assuming that the agent will prepare technical documentation or manage postmarket reporting.

The foreign establishment remains responsible for meeting the FDA requirements applicable to its devices and activities.

Choosing and Working With an Agent

    Evaluating Availability and Communication Procedures

A foreign manufacturer selecting a us fda agent should confirm that the provider meets the FDA’s location and availability requirements. MedEnvoy Global offers U.S. agent services for foreign medical device and in vitro diagnostic companies from its office in Austin, Texas.

MedEnvoy describes services that include facilitating FDA communications, responding to questions about the foreign establishment’s devices, and helping schedule FDA inspections. These functions are consistent with the duties listed by the FDA.

Before making an appointment, a manufacturer can ask:

    • Who monitors FDA communications during business hours
    • How urgent notices are escalated
    • How quickly messages are forwarded
    • Whether backup personnel are available
    • How contact information is kept current
    • Which languages the service team supports
    • What records of communications are retained
    • Which services require an additional agreement

The contract should identify the foreign establishment being represented and the effective date of the appointment. It should also explain how either party may end the relationship.

Distinguishing the Agent From the Official Correspondent

A foreign establishment’s U.S. agent and official correspondent can be the same person or organization, but the roles are not identical.

The official correspondent manages routine establishment registration and device-listing communications. Depending on the permissions provided, that person may create or update registration and listing information.

A U.S. agent serves the domestic communication functions defined by the FDA. A foreign establishment may appoint its agent as the official correspondent, but it is not required to do so.

Manufacturers should decide which party will manage registration and listing activities. The decision should be documented so that account access and renewal responsibilities are clear.

FDA registration information must generally be verified annually between October 1 and December 31. The manufacturer should know who will complete that process and who will pay the applicable establishment registration fee.

Keeping the Broader Regulatory Picture in View

    Requirements Beyond the Agent Designation

Appointing a U.S. agent satisfies only one part of the regulatory framework for a foreign medical device establishment.

Depending on the device and the establishment’s activities, requirements may include:

    • Establishment registration
    • Device listing
    • Premarket notification or approval
    • Quality Management System Regulation compliance
    • Labeling
    • Medical Device Reporting
    • Corrections and removals reporting
    • Unique Device Identification
    • Import documentation
    • FDA inspection readiness

Some devices are exempt from a 510(k), but exemption from premarket notification does not necessarily remove other regulatory obligations.

The FDA does not automatically recognize a regulatory authorization issued by another country. A CE mark or approval from a foreign authority does not replace the FDA requirements applicable to marketing or importing a device in the United States.

The manufacturer should determine its regulatory pathway according to the device’s classification and intended use.

Accounting for the Quality Management System Regulation

The FDA’s Quality Management System Regulation became effective on February 2, 2026. It amended 21 CFR Part 820 and incorporated ISO 13485:2016 by reference, together with additional FDA requirements.

Manufacturers should update articles and internal materials that refer only to the former Quality System Regulation. The current FDA term is Quality Management System Regulation, or QMSR.

A U.S. agent does not implement or maintain the foreign establishment’s quality management system merely by accepting the appointment. The manufacturer remains responsible for meeting the applicable requirements and making records available during an FDA inspection.

The FDA may review management-review records, quality-audit records, and supplier-audit reports during QMSR inspections. Manufacturers should prepare for this access under the current regulation.

An ISO 13485 certificate does not exempt a manufacturer from an FDA inspection. FDA inspections assess compliance with U.S. regulatory requirements.

Preparing for FDA Communications and Inspections

    Establishing an Internal Response Process

The foreign establishment should identify employees who will receive communications forwarded by the U.S. agent. Contact details should remain current, including during holidays or personnel changes.

    An internal procedure may explain:

    • Who reviews an FDA message
    • Who determines the response strategy
    • Which records must be gathered
    • Who communicates with legal or regulatory advisers
    • How deadlines are tracked
    • Who authorizes the final response
    • How communications are archived

The agent should know which contacts to use for routine questions and which personnel should receive urgent notices.

Manufacturers should not expect the agent to make substantive regulatory decisions without authorization. The establishment must remain involved in preparing accurate responses about its products and operations.

    Planning for an FDA Inspection

Foreign medical device establishments are subject to FDA inspection. The U.S. agent may assist with scheduling, but inspection preparation remains the manufacturer’s responsibility.

The establishment should maintain required records and ensure that knowledgeable personnel are available. Procedures should reflect the current QMSR and other applicable regulations.

Before an inspection, the manufacturer may review its registration information, device listings, complaint files, reporting procedures, and quality-system documentation. Any review should be based on the requirements applicable to the establishment and its devices.

An agent cannot guarantee that an inspection will proceed without observations. It also cannot prevent an enforcement action when the FDA identifies noncompliance.

Clear communication can help avoid scheduling confusion, but the outcome depends on the establishment’s regulatory compliance and the findings of FDA investigators.

    FAQ

Does every foreign medical device company need a U.S. agent?

The requirement generally applies to each foreign establishment engaged in specified activities involving devices imported or offered for import into the United States. The establishment should confirm its registration obligations based on the activities it performs.

Can a foreign establishment appoint more than one U.S. agent?

No. The FDA permits each foreign establishment to designate only one U.S. agent at a time. A single agent may represent multiple foreign establishments.

Can the U.S. agent use a post office box?

No. The agent must reside in the United States or maintain a physical place of business there. A post office box or answering service alone is insufficient.

Does the agent submit a 510(k) for the manufacturer?

Not as part of the legally defined U.S. agent role. The FDA expressly states that the agent has no responsibility for submitting 510(k) premarket notifications. Separate submission-support services may be arranged by contract.

Is the agent responsible for adverse-event reporting?

No. The FDA states that the agent has no responsibility for Medical Device Reporting under 21 CFR Part 803. The manufacturer should assign those responsibilities separately.

Can the U.S. agent also act as the official correspondent?

Yes. A foreign establishment may designate its agent as the official correspondent, but doing so is optional.

Does appointing an agent guarantee that a device can enter the United States?

No. Imported devices must meet all applicable FDA requirements. The agency may review registration, listing, premarket status, labeling, and import information when a shipment is offered for entry.

Can a U.S. agent guarantee faster FDA clearance?

No. FDA review time depends on the submission type, device, information provided, and agency review. A U.S. agent cannot guarantee clearance or a particular review timeline.
